The individual entrepreneur appealed to the arbitration court with a claim to a limited liability company for the recovery of commission.
A contract of commission has been concluded between the entrepreneur and the company, according to which the commission agent (the claimant in the case) undertook to conclude transactions for the sale of property belonging to the committent (the defendant). The plaintiff executed the order given to him, made a deal with the buyer and, in accordance with the commission order, was the first to fulfill his obligations as a seller to the buyer by transferring the goods sold. In violation of the terms of the concluded contract of sale, the buyer made the delay in payment for the goods. Upon the conclusion of this transaction, the commission agent sent a report to the committent with an attachment of supporting documents and demanded to pay him a commission, and having received a refusal, went to court.
