Artist Volkov signed a contract with Petrov

The artist Volkov signed a contract with Petrov for a cent car, a collection of paintings and an apartment for Petrov’s country house, with a land plot. After registering the car in the traffic police, Petrov took the paintings from Volkov and took them to the country. The transfer of participants in the exchange for new housing was planned immediately after the state registration of the exchange of real estate. However, after the transfer of documents for the registration of the barter agreement, Petrov’s dacha burned down for unknown reasons, along with it the car and the paintings.
Volkov demanded termination of the contract, exchange and reimbursement of the cost of the car and the collection of paintings. Petrov said that as an owner he was ready to come to terms with the loss of the car and the paintings, but he demanded to transfer the ownership of Volkov’s apartment to him, especially since its price corresponds to the value of the land plot under the burned house. The parties could not decide which of them is the owner of the lost things and who is at risk of their death. The dispute was brought to court. Solve the case.
